LGBT Rights

At Brophy & Lenahan P.C., we strongly believe that people of all sexual orientations should be afforded equal rights and opportunities, and we are committed to assisting lesbian, gay, bi-sexual and transgender individuals with their legal needs.  We are proud to offer the following services to LGBT individuals:

Immigration - Green Cards:  With the Supreme Court’s recent decision striking down DOMA, most LGBT bi-national couples can now petition for green cards.  For more information about this process, please read Kate Lenahan’s recent post about the decision striking down DOMA.

Immigration - Asylum:  Immediately after law school, Kate Lenahan served as a pro bono legal fellow at Immigration Equality, an organization dedicated to seeking asylum for LGBT immigrants who face persecution from their home countries.  Sadly, many countries still imprison or even worse, execute, their citizens because of their sexual orientation.  In addition, many countries condone violence against its LGBT citizens at the hands of the government, or people the government will not control.  We have successfully guided LGBT immigrants through the asylum process, preventing them from facing persecution if they were to return to their home countries.

Discrimination Litigation: If you are an LGBT individual who has been discriminated against due to your sexual orientation, you may have legal remedies.  In New York, for instance, the Sexual Orientation Non-Discrimination Act (“SONDA”) prohibits discrimination on the basis of actual or perceived sexual orientation in employment, housing, public accommodations, education, credit, and the exercise of civil rights.
